USTIANLIGHT, Inc. ("Ustianlight") Intellectual Property Policy

Ustianlight respects the intellectual property rights of others and expects its users to do the same. In compliance with the Digital Millennium Copyright Act of 1998 (DMCA), which can be reviewed on the U.S. Copyright Office website here, Ustianlight will promptly address any claims of copyright infringement that occur on or through the Ustianlight Services or any Ustianlight website (the "Website"). Any claims must be reported to Ustianlight’s designated copyright agent as described below.

DMCA Notification of Alleged Infringement ("Notification")

If you are a copyright owner, authorized representative, or have exclusive rights under copyright, and believe your copyrighted work has been infringed on the Website, please submit a DMCA Notification of Alleged Infringement to Ustianlight's designated copyright agent. Upon receipt of a valid notification, Ustianlight will take appropriate action at its sole discretion, including removing or disabling access to the allegedly infringing content.

Please ensure that your DMCA notice includes the following information:

  1. Identification of the copyrighted work: Specify the copyrighted work that you claim has been infringed, or if multiple works are covered, provide a representative list.

  2. Identification of infringing material: Identify the specific material or link on the Website that you claim is infringing (or subject to infringement) and request removal or access disablement, including the URL or exact location.

  3. Contact Information: Provide your company affiliation (if applicable), mailing address, phone number, and email address.

  4. Good Faith Statement: Include the following statements in your notice:

    • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as fair use)."

    • "I hereby state that the information in this notification is accurate, and under penalty of perjury, I am the owner of the copyright or an exclusive right under the copyright that has allegedly been infringed, or I am authorized to act on behalf of the owner."

  5. Signature: Provide your full name and electronic or physical signature.

DMCA Counter-Notification of Alleged Infringement

If you believe that content removed from the Website was done so by mistake or misidentification, or if you are authorized by the copyright owner or under the law to post and use the material, you may submit a counter-notification to Ustianlight’s copyright agent with the following information:

  1. Signature: Your physical or electronic signature.

  2. Identification of Removed Content: Specify the content that was removed or disabled, providing evidence of misidentification.

  3. Contact Information: Include your name, address, phone number, email address, and a statement of consent to jurisdiction in Alachua County, Florida, and that you will accept service of process from the notifying party.

Upon receipt of a valid counter-notification, Ustianlight may forward a copy to the original complainant, who will have ten business days to take legal action if they wish. Otherwise, the content may be restored within 10 business days or more.

Ustianlight Policy Regarding Repeat Infringers

Ustianlight does not tolerate copyright infringement or any violations of intellectual property rights. We reserve the right to suspend or terminate the access and/or use privileges of any person deemed a "repeat infringer." A "repeat infringer" is generally defined as anyone to whom Ustianlight has received two or more DMCA notifications of alleged infringement.

Ustianlight retains the right to define what constitutes a "repeat infringer" and may apply applicable legal standards. In the event that Ustianlight takes action against a repeat infringer, it does not waive its right to seek legal remedies for copyright infringement.

Furthermore, Ustianlight does not indemnify or provide legal representation for any alleged infringer. All legal actions arising from an alleged infringement are the responsibility of the infringer, except as explicitly stated in this policy.
